Court Strikes Down N60bn ARCON Fine on Facebook Nigeria

The Federal High Court in Lagos has ruled that the Advertising Regulatory Council of Nigeria (ARCON) exceeded its statutory powers by imposing a N60 billion penalty on Facebook Nigeria. Justice Yellim Bogoro held that ARCON’s October 21, 2024 notice was unconstitutional and unlawful. The judge found that the regulator failed to provide a fair hearing and lacked authority to impose a punitive sanction without judicial process. The court also determined that Facebook Nigeria is a separate legal entity from Meta Platforms Inc. and declared ARCON’s demand null and void. A perpetual injunction now prevents the regulator from enforcing the disputed notice.
