Court Allows EFCC to Probe Intels Over Alleged $74m NPA Debt
A Federal High Court in Abuja has dismissed Intels Nigeria Limited’s bid to stop the EFCC from investigating transactions linked to an alleged $74 million debt to the Nigerian Ports Authority. Justice Emeka Nwite held that a contract dispute and an arbitration clause do not prevent a criminal investigation where there are separate allegations of fund diversion or conversion. The EFCC alleged that some payments meant for the NPA were directed to an Intels-linked account in the United Kingdom. The court stressed that the EFCC cannot use its investigation to determine the final contractual accounts between Intels and the NPA. The ruling permits a lawful probe to continue but does not amount to a criminal conviction or a finding that Intels owes the alleged debt.
