What Polling Agents Can Record and Collect Under the Electoral Act
Polling agents may inspect original electoral materials before voting begins. Under Section 41(4), the inspection may be recorded in writing, on video or through other means as evidence. After the polling-unit result is entered on Form EC8A, signed and stamped, the Presiding Officer is required to transmit it to IReV under Section 60(3). Candidates or their agents may countersign where they are present. Agents should also secure a countersigned copy of Form EC8A before leaving the polling unit. Section 71(1) provides for result-form copies to be given to polling agents where available. Recording irregularities is useful, but the signed result form remains key evidence.
