How Long Can Police Detain a Suspect Before Taking Them to Court in Nigeria?
An arrest is not proof that a person is guilty. Nigerian law protects the right to personal liberty and requires arrested persons to be brought before a court within a reasonable time. Generally, this is within one day where a court is located within 40 kilometres, or within two days where there is no court within that distance. A longer period may only be justified by the circumstances and proper legal process. Police may investigate and question suspects, but they cannot keep someone in custody indefinitely because an investigation is ongoing. If more time is needed, investigators may have to seek a court order for remand or further detention. A person in custody has the right to know the reason for their arrest, seek legal assistance and avoid answering questions until consulting a lawyer or another person of their choice, subject to the law. Where detention is unlawful, the suspect or their lawyer can challenge it in court.
