Supreme Court Upholds Electoral Act Rules on Party Primaries and Membership Registers
The Supreme Court has upheld INEC’s appeal against a Court of Appeal decision that voided parts of the Electoral Act 2026 relating to party primaries and membership registers. The court ruled that Sections 77(5) and 84 of the Act do not conflict with the 1999 Constitution. The provisions regulate party membership records and participation in party primary elections. The apex court set aside the Court of Appeal judgment in favour of the Zenith Labour Party and restored the Federal High Court decision. It also awarded ₦2 million in costs against the party. In separate cases, the court dismissed an appeal by the Social Democratic Party and struck out the Youth Party’s appeal after upholding INEC’s preliminary objection.
