Tinubu FOIA Case: Why Nigerians Want Full Disclosure of FBI and DEA Records
The Presidency has said the FBI and DEA released 399 pages of records in the FOIA case, with some portions redacted. It also confirms that President Bola Tinubu, through his lawyers, has invoked privacy protections while the case continues. The central issue is not whether the FOIA lawsuit is a criminal trial. It is whether the records can be disclosed and what information the court considers lawful for the public to see. A 2003 consular letter stating that an FBI check found no arrest records, wants or warrants at the time does not settle every question about records from other periods. FOIA exemptions determine what information may be withheld. They do not by themselves establish that every allegation is true or false. With material reportedly submitted to the judge for private review, Nigerians should await the court's decision on what can lawfully be released. This debate should focus on transparency, accountability and the public interest, rather than the political identities of those seeking the records.
