Appeal Court Clears Fidelity Bank in Michael Kundera Rights Case
The Court of Appeal in Abuja has overturned a Federal Capital Territory High Court decision that held Fidelity Bank liable for the alleged violation of Michael Kundera’s fundamental rights. Kundera had alleged that he was unlawfully arrested and detained by the EFCC between May 15 and 16, 2023, over a dispute linked to land at the Foreign Affairs Quarters. In 2024, the trial court awarded him ₦10 million in damages and ₦2 million in costs against the respondents. Fidelity Bank argued that it only submitted a petition to the EFCC over alleged diversion of funds connected to a ₦100 million loan procurement order. The bank maintained that Kundera was not named in that petition. The appellate court held that no credible evidence connected Fidelity Bank to Kundera’s arrest, detention or the alleged rights violation. It therefore set aside the finding of liability against the bank.
