A Utah district court judge has postponed a decision on whether prosecutors violated a pretrial publicity order in the case of Tyler Robinson, accused of killing conservative commentator Charlie Kirk, and if so, whether to remove the death penalty as an option. Judge Tony Graf set a new hearing for Friday to debate contempt charges after comments made by a prosecutor sparked the motion. He also ruled that hearsay evidence will be allowed at the preliminary hearing scheduled to begin next month. Robinson faces charges including aggravated murder, firearm use and obstruction of justice. His defense argues that any violation of the publicity order should bar the death penalty, while prosecutors say such a penalty would be “grossly disproportionate.”
