US Man Freed on Bail After DNA Evidence Excludes Him From 1985 Killing

A Utah judge has granted bail to Douglas Stewart Carter, 71, after new DNA tests excluded him as a possible source of blood and genetic material found at the scene of a 1985 killing. Carter had spent about 41 years in custody, much of it on death row. Carter was convicted largely on a signed confession and testimony from two witnesses. He has long maintained that police coerced the confession. The Utah Supreme Court ordered a new trial last year after finding intentional misconduct by investigators and a prosecutor. The two witnesses later said they were pressured to give false testimony and received cash and gifts from police. Prosecutors have dropped their plan to seek the death penalty at the retrial, while they review the remaining evidence in the case.
