Why Lagos Law Officers Seek Retirement Age Parity With Magistrates
The proposed amendment to the Lagos State Magistrates’ Court Law has sparked debate over plans to raise the retirement age of Law Officers in the Ministry of Justice from 60 to 65 years. Supporters say the proposal is not a new privilege. They argue that it completes a harmonisation policy approved by the Lagos State Government in 2021, under which State Counsel began receiving some benefits available to Magistrates. The issue became more urgent after the retirement age for High Court judges rose from 65 to 70 years. Fewer vacancies on the High Court Bench could mean experienced Chief Magistrates and Directors of Law retire at 60 before they can be considered for elevation. Advocates also note that states including Abia, Kogi, Benue, Imo and Kwara have adopted similar frameworks. They maintain that Lagos should retain experienced legal officers while using proper succession planning to protect opportunities for younger officers.
