Why Sunrise Power’s $2.35bn Mambilla Claim Failed at ICC Tribunal
The International Chamber of Commerce tribunal dismissed Sunrise Power’s $2.35 billion claim over the Mambilla Hydroelectric Power Project. It also rejected a proposed $400 million settlement claim and ordered the company to reimburse Nigeria about $11.82 million in legal and related costs. I attended the Paris hearing in January 2025 and observed Nigeria’s defence, which relied on evidence that the Federal Executive Council had not approved the 2003 Mambilla contract claimed by Sunrise. Nigeria also argued that later settlement discussions and documents were subject to presidential approval, which was ultimately withheld. The ruling removes a major legal obstacle to the proposed 3,960MW Mambilla project. The next priority is for the Federal Government to secure financing and restart progress on a project that has faced years of delays.
