Falana: Courts Should Not Decide Nigeria’s Election Winners

Human rights lawyer Femi Falana says Nigeria must end a system in which courts determine the winners of elections after votes have been cast. Speaking on a television programme, Falana argued that excessive judicial intervention can undermine the choices made by voters. He said INEC, the media and other stakeholders must work to ensure credible elections and prevent the announcement of false results. He pointed to the Osun governorship election, saying credible polls should reduce the need for disputes at election tribunals and appellate courts. According to him, the judiciary’s role in the electoral process should be strictly limited by conducting elections that clearly reflect the people’s will.
