Court Dismisses WASPAN Suit, FCCPC’s Digital Lending Rules to Take Effect

Court Dismisses WASPAN Suit, FCCPC’s Digital Lending Rules to Take Effect

The Federal Competition and Consumer Protection Commission won a key ruling when the Federal High Court in Lagos struck out WASPAN’s challenge to its Digital, Electronic Online or Non-Traditional Consumer Lending Regulations 2025. WASPAN had sought to halt the rules and briefly secured a restraining order. In line with the court’s earlier directive, the FCCPC paused implementation and announced plans to contest the interim order. With the originating summons now dismissed, the injunction is lifted and the Commission can resume enforcement. The DEON Regulations aim to set clearer standards for digital lenders, boost consumer protection and ensure accountability in Nigeria’s fast-growing online lending sector.

Lenders should begin updating their compliance processes immediately, mapping out system adjustments to align with FCCPC's digital lending requirements by the enforcement date.
