US Couple Sue Surrogate for $100,000 After She Refused to Abort Baby With Heart Defect
A US couple have filed a countersuit seeking more than $100,000 from surrogate McKenna West after she refused to terminate a pregnancy following a diagnosis of hypoplastic left heart syndrome, a severe congenital heart defect. The biological parents, Nausheen Gilkar and Omar Ahmed, argue that West breached their surrogacy agreement, which they say included provisions on pregnancy termination in certain circumstances. They also allege emotional distress and say they paid her about $60,000 during the pregnancy. West denies wrongdoing and is asking the court to dismiss the case. West gave birth to the baby in Texas on August 12, 2026. The child has since undergone the first of several complex heart surgeries. The dispute has raised wider questions about surrogacy contracts, abortion decisions, disability, custody and the rights of surrogates and intended parents.
