Can Nigerian Police Enter Your Home Without a Search Warrant?
Police officers cannot enter and search a private home simply because they want to. In many cases, a valid search warrant is required. The warrant should state the legal grounds, identify the premises as clearly as possible and describe the person or item being sought. When executing a warrant, an officer should identify themselves, show official identification where necessary, produce the warrant and give the occupier a copy. However, there are limited exceptions. If officers have lawful authority to arrest a person they reasonably believe is inside, they may demand access and can force entry after stating their authority and purpose if access is refused. Emergency laws may also permit warrantless entry in narrowly defined cases, including urgent threats to public safety. If police arrive, stay calm and do not physically resist. Ask why they are entering, request to see any warrant, keep a safe record of events and seek legal advice if you believe the search was unlawful.
