Kanu Legal Consortium Challenges Federal High Court’s Jurisdiction Over 2025 Trial
A legal consortium representing IPOB leader Nnamdi Kanu has argued that the Federal High Court lacked jurisdiction to continue his trial on March 21, 2025. The group made the claim in a briefing released on October 5, 2026. The consortium said the charge relied on the Terrorism (Prevention) (Amendment) Act 2013, which it argued had been repealed by the Terrorism (Prevention and Prohibition) Act 2022. It contended that a criminal charge must cite valid and subsisting laws before a court can take a plea, hear evidence or proceed with a trial. Relying on Supreme Court decisions, including Madukolu v. Nkemdilim, the group argued that a remittal order, trial proceedings or conviction cannot cure an alleged lack of jurisdiction. It urged the Court of Appeal to first determine whether the charge sheet had a valid legal foundation before considering Kanu’s guilt or innocence.
