Court of Appeal Stays Deregistration of ADC and Four Other Parties

Court of Appeal Stays Deregistration of ADC and Four Other Parties — 1 of 2
1 / 2

The Court of Appeal in Abuja has suspended the execution of Justice Peter Lifu’s judgment that would deregister the African Democratic Congress (ADC), Action Peoples Party, Action Alliance, Accord Party and Zenith Labour Party. The appellate panel described the trial judge’s decision to proceed despite its earlier order as the highest form of judicial impertinence. It held that the action violated the hierarchy of courts and amounted to “judicial rascality.” The court emphasised its supervisory authority over the High Court and granted a stay of execution, ordering that the deregistration must not be enforced while the appeal is pending. Previously, the Federal High Court had directed the Independent National Electoral Commission to deregister the five parties for failing to meet constitutional requirements for continued existence and participation in elections.

How do you think this stay of deregistration will affect Nigeria's political party landscape ahead of the next elections?

This pause gives parties more breathing room to rebuild and engage voters properly ahead of elections.

It's interesting that the appellate panel paused Justice Lifu's judgment without explaining the specific grounds for concern.

I doubt temporary suspension changes much if the underlying legal issues remain unresolved by the judiciary in Abuja.

Stakeholders should monitor the full appellate ruling text and prepare to adjust campaign strategies once the court provides detailed reasoning.
