ECOWAS Court Declares Darma’s Removal and Replacement Unlawful
The ECOWAS Court of Justice has ruled that the removal and replacement of former Commissioner for Internal Services, Prof. Nazifi Abdullahi Darma, did not comply with Community law. The court held that Nigeria’s recall of Darma did not automatically end his appointment or create a vacancy. It found that ECOWAS authorities did not meet the legal requirements for ending his mandate and failed to give him an adequate opportunity to respond to allegations. The court ordered ECOWAS to pay Darma his outstanding salary and benefits until the end of his tenure. It also awarded him $50,000 in damages and directed the Commission to cover the legal costs. Darma described the judgment as a victory for due process, institutional integrity and accountability within ECOWAS.
