APC’s Primaries Delay Sparks Risk of Mass Litigation
It looks like the APC has shot itself in the foot by choosing a path that even INEC would hesitate to tread. After selling nomination forms to aspirants they knew they could disqualify, the party raked in millions only to bar nearly one-third of buyers from the race. Then the real complication hit. For over 48 hours, results from Senate primaries have been withheld. Electoral committees nationwide were stripped of the power to declare winners until their figures are vetted in Abuja. This contradiction—empowering committees to vote but not to announce outcomes—is setting the stage for legal battles. Now aggrieved aspirants can challenge the process in court, arguing that APC violated its own Constitution and nomination guidelines. Article 20.4 of the party’s Constitution and Section 9(ii)(e) of its rules require results to be declared at the venue by the supervising committee. When these disputes land in court, the focus will shift from who won to whether APC followed due process.
