Federal High Court Affirms APC-Elected Council Chairmen in Osun, Dismisses APP Suit
The Federal High Court in Osun State has dismissed a suit by the Action Peoples Party (APP) challenging the reinstatement of council chairmen and councillors elected under the All Progressives Congress (APC) on October 15, 2022. In Suit FHC/OS/CS/103/2022, Justice Demi-Ajayi ruled that a February 10, 2025 Court of Appeal judgment had already set aside the November 2022 decision that removed the APC officeholders. He held that the councillors cannot be in contempt for resuming their elected roles. The court struck out several respondents for defective service, finding that only the APC was properly served. It also dismissed the contempt application against the APC as lacking merit and ordered each party to bear its own legal costs. Counsel for the APP described the verdict as “justice seen, justice served,” while APC lawyers praised it as “well considered.” The judgment reinforces the autonomy of local government in Osun State.
