Businessman Must Pay N25M for Unlawful Detention of Ex-Employee

A Federal High Court in Ilorin has awarded N25 million in damages against KAM Integrated Company Ltd. and its chairman for holding a former employee in custody for 23 days without a court order or police warrant. Justice Ariwoola Junior found that the detention breached the employee’s fundamental human rights and held that the chairman had no constitutional authority to detain him. The court also ordered the Economic and Financial Crimes Commission to pay damages for abusing its investigative powers by pursuing a matter already closed by the police. An additional N5 million was awarded against the company’s Chief Security Officer for executing the detention. The police commissioner was cleared of liability due to lack of evidence linking him to the arrest. The ex-employee had originally sued after the company accused him of misappropriating over N5 billion.
