INEC Introduces 48-Hour Deadline for Candidates to Challenge Election Results

INEC Introduces 48-Hour Deadline for Candidates to Challenge Election Results

INEC’s Regulations and Guidelines for the Conduct of Elections, 2026, now requires any candidate disputing declared results to submit a written report to the Chairman within 48 hours of the declaration. This report must detail specific evidence showing breaches of the Electoral Act 2026. If the submission indicates that a return was made under duress or contrary to prescribed procedures, the Chairman must convene an emergency Executive Session within 24 hours to review the case. Only the Returning Officer directly involved or the Resident Electoral Commissioner may file such a report. Candidates must gather all relevant proof quickly to meet this tight deadline before pursuing an election petition tribunal or court challenge.

Gathering specific proof of electoral breaches often takes weeks, so a rigid two-day deadline looks impractical given our logistical constraints.

I'm not convinced that rushing claims serves democracy. Candidates need breathing room to build solid cases, not just race against time.

Campaign teams should start collating witness statements and polling records immediately after results are announced to meet that tight 48-hour deadline.
