Protecting Nigeria’s Democracy: NBA’s Warning Against Judicial Overreach

Protecting Nigeria’s Democracy: NBA’s Warning Against Judicial Overreach — 1 of 3
1 / 3

The Nigerian Bar Association warns that recent actions by lawyers and some courts risk violating the Electoral Act 2026’s clear ban on judicial involvement in political party affairs. These moves undermine the rule of law and threaten the integrity of elections. Lawyers are reminded that they serve as ministers in the temple of justice, not political agents. Anyone who files or secures injunctions in clear breach of the statute risks disciplinary proceedings before the Legal Practitioners Disciplinary Committee. The NBA urges judges to decline suits barred by law and calls on the National Judicial Council to sanction any officer who knowingly assumes jurisdiction over intra-party disputes. It also asks INEC’s leadership to maintain strict neutrality and uphold democratic norms. Through advisory opinions, strategic litigation, and disciplinary measures, the Bar will safeguard the justice system from being weaponized for political gain. Nigeria’s democracy must remain protected by law and free from procedural manipulation.

I'm not convinced every court action equates to overreach; some interventions may simply correct procedural errors in party nominations.
