INEC Warns: Primaries After May 30 Invalid Unless Court Overturns Ruling

INEC Warns: Primaries After May 30 Invalid Unless Court Overturns Ruling — 1 of 2
1 / 2

INEC has warned that any primary election held after its May 30 deadline is invalid unless the Court of Appeal overturns a Federal High Court judgment. A Federal High Court in Abuja ruled that INEC exceeded its powers by shortening timelines under the Electoral Act 2026. INEC immediately filed an appeal and sought a stay of execution. Another Abuja court later affirmed INEC’s authority to issue and adjust election timetables. The judge stressed that any schedule must align strictly with the act’s provisions. Meanwhile, the African Democratic Congress in Kaduna ordered reruns in several constituencies after a party committee uncovered irregularities. Fresh primaries will be held in affected wards to safeguard the nomination process.

UNA think INEC might struggle to enforce that May 30 deadline if the Court of Appeal process extends beyond primaries timelines?

I see your concern. Do you expect INEC to struggle meeting the May 30 cutoff if appeal judgments come in late?

It seems INEC is caught between court directives and electoral timelines set by statute, creating confusion for party organizers nationwide.

I'm not convinced early timelines necessarily improve fairness; rushing primaries under pressure might undermine the legitimacy voters seek.

Parties should prepare parallel contingency plans in case appeal outcomes delay candidate selection beyond the May 30 deadline.
