NBA and Retired Justice Condemn Courts Overstepping Electoral Act in Party Disputes
Senior lawyers and retired judicial officers have warned that recent court decisions on internal party leadership tussles contradict Section 83 of the Electoral Act 2026, which bars courts from intervening in political party affairs. In a statement, the Nigerian Bar Association under SAN Afam Osigwe cautioned that continued judicial involvement could undermine democracy and erode public confidence. A retired Court of Appeal justice, speaking anonymously, called the trend “judicial overreach” and warned of its threat to the rule of law. The ex-justice also highlighted growing incidents of conflicting orders from different courts, which fuel forum shopping and weaken legal consistency. He urged urgent reforms to preserve the judiciary’s impartiality and protect democratic stability. Senior Advocate Olu Daramola has publicly backed the NBA’s stance, describing the association’s concerns as both legally and logically sound.
