Inheritance Dispute: Kaduna Shari’a Court of Appeal Adjourns Stay Hearing to June 17

Inheritance Dispute: Kaduna Shari’a Court of Appeal Adjourns Stay Hearing to June 17

A Shari’a Court of Appeal in Kaduna has adjourned its ruling on a stay of proceedings until June 17. The application was filed pending the outcome of an appeal in a long-running inheritance dispute over properties in Kaduna, Plateau, Taraba, Lagos and assets in the UK. The appeal was launched by Edwina, Jamal, Ibrahim, Faisal and Aisha Ibrahim, the first wife of the late Ibrahim Muhammad Tunba, who died in October 2021. They are challenging a judgment from the Upper Shari’a Court and seeking to vacate a default decision made in March 2024. At the resumed hearing, counsel for the respondents called two witnesses, while the appellants’ lawyer filed a 15-paragraph counter-affidavit and asked the court to dismiss the stay application. Presiding Judge Mustapha Sulaiman has fixed June 17 for the final ruling.

Another adjournment only prolongs uncertainty, and I doubt it helps the heirs reach a swift settlement.

Parties involved might consider mediation sessions before June 17 to narrow issues and save on escalating court expenses.
