High Court Upholds Adenike Ajayi as Sole Widow of Late Dr. Tosin Ajayi, Dismisses Helen Prest’s Claim

A Lagos State High Court in Ikeja has ruled that Mrs. Adenike Ajayi is the only lawful widow of the late Dr. Tosin Ajayi, founder of First Foundation Hospital. Justice Oluwayoyin Odusanya granted all reliefs sought by Mrs. Ajayi and her children, throwing out former beauty queen Helen Prest’s claim of a customary marriage. The dispute began after Dr. Ajayi’s death in April 2020 and dragged on for almost five years. The court found no credible evidence for Prest’s alleged Kalabari customary marriage and noted inconsistent legal positions in her earlier filings. The judgment confirms that separation alone does not end a valid marriage without formal dissolution. Mrs. Ajayi is entitled to one-third of the personal estate and is the only spouse eligible to apply for letters of administration.
