Ex-INEC Director Faults INEC’s De-Recognition of David Mark’s ADC Leadership

Barr. Oluwole Osaze-Uzzi, a former INEC director, argues the commission misinterpreted an Appeal Court order in the ADC leadership dispute. He says the order only aimed to preserve the case subject matter, not strip legitimacy from any faction. Osaze-Uzzi insists the ADC can go ahead with its planned congresses as long as it respects the court’s authority. He points out the court did not direct INEC to withdraw recognition from either side. He also notes that the Electoral Act requires only a 21-day notification to INEC before a party convention. Physical attendance by INEC officials is not a condition for the validity of internal party elections.

With Osaze-Uzzi's argument in mind, how might the ADC factions proceed to clarify their leadership legitimacy and avoid further legal confusion?

Definitely, a joint committee and transparent party congress can help settle leadership questions once and for all.

It does seem INEC could have overstepped if the Appeal Court order was only about preserving status quo, not stripping any group's validity outright.

Hold on, maybe Osaze-Uzzi is overlooking some details. INEC could have valid reasons not fully addressed by his argument.

Both factions should request explicit judicial clarification and update their party documents accordingly before holding any internal elections.
