El-Rufai Withdraws N1bn Rights Suit Against Abuja Magistrate
Former Kaduna Governor Nasir El-Rufai has withdrawn his suit against a chief magistrate in the N1 billion fundamental rights case at the Federal High Court in Abuja. His lawyer, Ugochukwu Nnakwu, informed Justice Joyce Abdulmalik that a motion was filed to remove the magistrate as second defendant. Justice Abdulmalik struck out the magistrate’s name and related motion. When El-Rufai’s team sought time to amend the suit, ICPC counsel Abdul Mohammed argued that removing the magistrate left no case. The judge replied that a counter-affidavit could be filed and adjourned the matter to June 17 for amendments. El-Rufai is seeking N1 billion in damages from the ICPC, the Inspector-General of Police and the Attorney-General of the Federation over a search of his residence. He claims the search breached his rights to dignity, personal liberty, fair hearing and privacy. The ICPC and police maintain the search was lawful under a valid warrant.
