Supreme Court’s ADC Ruling a ‘Banana Peel’: Time for a New Clean Party
Two days after my initial statement, the apex court has sent the ADC leadership dispute back to the Federal High Court “for determination on the merits,” calling the Court of Appeal’s interim order “unnecessary, improper and unwarranted.” Justice Garuba insists that questions of who controls the party must be fully heard at trial. This “banana peel” judgment contradicts earlier rulings and the Electoral Act framework, which held that courts should avoid deciding internal party disputes. By reviving domestic politics litigation, the decision creates a slippery slope that could trip up future party leadership contests. As a result, serious presidential aspirants—particularly Peter Obi—should secure tickets in newer, cleaner parties now, rather than face protracted court battles later.
