Olanipekun SAN: Nigeria’s 1999 Constitution Is Unamendable – Call for Regional Referendums

In a recent video, Chief Wole Olanipekun SAN argues that Nigeria’s 1999 Constitution is fundamentally flawed. He points out that the Preamble’s “We the People” clause is fake because Nigerians never drafted or ratified the document. He warns that if the Preamble cannot be amended, the whole constitution lacks legitimacy. He also highlights that Nigeria operates as a unitary state under a false federation since no region has its own constitution. Based on these concerns, NINAS proposes a two-stage transition. Stage one would hold regional referendums to let each area reaffirm or opt out of the union. Stage two would define a new agreement’s terms based on those results. Please share widely.

How realistic is the idea of regional referendums when the federal constitution itself is deemed unamendable by the SAN?

You dey talk correct, asking for regional referendums under unamendable constitution na real uphill battle.

Labeling the constitution unamendable doesn't necessarily block regional votes; inventive legal processes can still open space for local referendums.

It's striking that Olanipekun questions the Preamble's legitimacy since he admits Nigerians never directly ratified the 1999 Constitution.

Claiming the constitution is unamendable seems exaggerated, given we've amended it several times already. We need more nuance here.

Instead of regional referendums, maybe we should strengthen civic education and mobilize state assemblies to push for constitutional reviews within existing frameworks.
