Senate Passes Amendment to Clarify Court Jurisdiction in Pre-Election Disputes
The Senate on Thursday approved changes to the 2026 Electoral Act to clearly define which courts handle pre-election disputes. The report by the Senate Committee on INEC highlighted gaps in timelines and jurisdiction that have led to conflicting rulings and delays. Under the new provisions, aspirants can file suits in the Federal Capital Territory or where their case arose. A dedicated Section 29A will assign pre-election cases for National Assembly, governorship, and state assembly contests to the Federal High Court, with appeals at the Court of Appeal. Disputes over the presidency and vice presidency will start at the Court of Appeal, with final appeals to the Supreme Court. Senators say the amendment will prevent forum shopping, reduce delays, and strengthen the credibility of Nigeria’s electoral process.
