56 Anambra Councillors Challenge Two-Year Local Government Tenure in Court

Fifty-six serving councillors in Anambra State have filed a suit at the High Court in Awka. They are asking the court to declare the recently passed law fixing local government tenure at two years as unconstitutional. The plaintiffs argue that Section 7(1) of the 1999 Constitution guarantees a stable, reasonable tenure and does not allow arbitrary truncation of elected terms. They seek to nullify Section 110(A) of the Anambra State Electoral (Amendment No. 3) Law, 2024 and have it expunged from state law. The suit names the state Attorney General, the House of Assembly and the State Independent Electoral Commission as defendants. The councillors want a declaration that all elected local government officials should serve a uniform four-year term, and an order preventing any election or dissolution before that period elapses. The case was filed just weeks before the scheduled local government elections on August 29.
