Police Seek Virtual Testimony from US-based Engineer in N152m Fraud Trial

Police Seek Virtual Testimony from US-based Engineer in N152m Fraud Trial

Prosecutors have asked the Federal High Court in Lagos to allow US-based engineer Anthony Ugbebor to testify via video link in the N152 million fraud trial of property developer Olukayode Olusanya. The application, backed by a detailed affidavit, argues that electronic evidence is permitted under court rules and that forcing physical attendance would delay the case. Defence counsels counter that the law mandates in-person testimony and question the credibility of the reasons given for the witness’s absence. Justice Musa Kakaki has adjourned the ruling until May 12, 2026. Olusanya and his company, Oak Homes Ltd, face charges of conspiracy, obtaining money by false pretence, fraud and stealing. They pleaded not guilty in November 2024 to allegations of defrauding Ugbebor over property sales between 2017 and 2020.

How might virtual testimony affect the credibility of witnesses in a high-profile fraud trial like this one?

You're right. Virtual testimony could make it harder to read body language but helps secure testimony from abroad.

Not sure virtual testimony really undermines witness trust, courts can still gauge demeanour and screen for inconsistencies.

It's unusual for a local trial to rely so heavily on electronic evidence and remote testimony from abroad.

I'm not convinced that a video link can fully replace in-person cross-examination without risking procedural fairness.

The court should verify stable connection and authenticated documents before approving remote testimony to avoid future disputes.
