Landmark Ruling: FCT High Court Quashes Charges Against H-Medix Pharmacy and Affirms Area Councils’ Sanitation Powers
On May 21, the FCT High Court granted H-Medix Pharmacy Ltd orders of certiorari and prohibition. The court quashed all criminal proceedings filed by the FCTA Health and Human Services Department and halted further action under national public health and environmental regulations. In its judgment, the court ruled that Area Councils have exclusive authority over sanitation and health inspections under Section 7 of the Constitution.
