Electoral Act 2026 Bars Courts from Intervening in Party Disputes
The Electoral Act 2026 removes judicial oversight of internal party matters. Section 83(5) now prevents any Nigerian court from hearing suits about party leadership struggles or candidate selections. Subsection 6 suspends interim injunctions until final judgment and demands accelerated hearings. It also mandates a minimum ₦10 million fine each for the plaintiff and their lawyer, plus any commission costs. Section 88(4) goes further by barring courts from halting primaries or general elections while cases are pending. These measures aim to curb endless legal battles that disrupt party processes and election timetables.
